Terms of use
What you agree to when you subscribe.
What you're signing up for, what it costs, when it renews and how you leave. Written to be read in full — that's why it's short.
This English version is provided for convenience. The Spanish version is the legally binding text.
The deal, in three lines
- No lock-in. Cancel whenever you like from your dashboard; the service runs until the end of the period you've already paid for.
- If we don't approve your application, everything is refunded. The full amount, no proration, within fourteen days.
- No commission. Vinté+ doesn't charge for the garment or keep a cut. The sale is yours and happens at your counter.
What you're subscribing to
Vinté+ is a subscription service that lets a physical vintage or second-hand clothing shop publish its listing, its catalogue and its opening hours in the Vinté+ directory and app, and receive holds when its plan includes them.
Vinté+ doesn't sell clothes and takes no part in the sale. It doesn't charge for the garment, doesn't keep a commission and isn't a party to the contract between the shop and the buyer. Putting a piece on hold from the app is not a purchase and creates no obligation to buy: it reserves the piece for 48 hours and takes it off the shop window in the meantime.
What each plan includes is set out on the pricing page, capability by capability. That table forms part of these terms.
Who can subscribe
Businesses only: natural or legal persons acting in the course of their professional or business activity, with a physical establishment open to the public.
These terms are not a consumer contract. Whoever subscribes does so for their business, so they do not qualify as a consumer and consumer rights do not apply to them — including the fourteen-day withdrawal right under the consolidated text of the Spanish General Consumer Protection Act.
Whoever accepts these terms declares that they have the authority to bind the business they represent.
Applying, and approval
You sign up on the website: you create an account, provide your shop's details and, if you've chosen a paid plan, pay at that point.
The listing isn't published instantly. Every application is reviewed before it appears in the directory and the app. The review checks that the business exists, that it is where it says it is and that its activity fits the directory; it doesn't judge taste or stock.
While the review is under way the shop already exists, is managed from its dashboard and can prepare its catalogue. It simply isn't visible to the public yet.
If an application isn't approved
Everything charged is refunded in full. If an application that has already paid is declined, the subscription is cancelled and the full amount of the period paid is refunded — no deductions, no proration — via the same payment method, within the fourteen calendar days following the decision.
That's the flip side of payment coming before publication: whoever pays up front can't be asked to carry the risk of a decision that isn't theirs to make.
The decision is always communicated in writing, with the reason. If the rejection is down to something fixable — an incomplete address, photographs that aren't of the shop — we say what's missing, and you can reapply without paying again.
Prices, taxes and invoicing
Prices are those published on the pricing page and are shown with VAT included: the advertised amount is what gets charged, with no surcharges added at payment. The invoice itemises the tax contained in that amount.
For businesses established in another EU member state that provide their intra-Community VAT number, the invoice is issued without VAT under the reverse-charge mechanism. You provide the number during checkout.
Payments are processed by Stripe Payments Europe, Ltd. Vinté+ never stores card details at any point.
Renewal and plan changes
Monthly subscriptions renew every month and yearly ones every year, automatically, until cancelled. The yearly plan is charged up front and equals 10 monthly payments: 2 months go uncharged.
The Custom plan is a one-off payment with maintenance included, and comes with three months of Premium at no cost — counted from the day the finished website is handed over, not the day you sign up.
You can move up or down a plan at any time from your dashboard. A mid-period change is prorated by Stripe. Downgrading removes that tier's features but deletes nothing: pieces beyond the new plan's limit are hidden, and come back in the same order when you upgrade.
If a plan's price changes, we give thirty days' notice to the shop's email address and the new amount applies from the next renewal. Until then the contracted price stands, and anyone who doesn't accept the change can cancel before it takes effect.
Cancellation
No lock-in. You can cancel the subscription whenever you like from your dashboard, with no explanations and no emails to write.
Cancellation takes effect at the end of the period already paid: the service runs until that date and the next period isn't charged. The unused part of the current period isn't refunded, except in the cases of a declined application or a suspension not attributable to the shop described in these terms.
When the subscription ends, the listing doesn't disappear: it returns to the Directory plan, which is free, and the business stays on the map. To leave the directory entirely you have to ask, and the listing is removed along with its content.
What each shop publishes, and what it answers for
Each shop is responsible for what it publishes: its details, its opening hours, its prices, its photographs and the description of its stock. It must hold the rights to the images it uploads and be truthful about the condition and provenance of its pieces.
Unlawful, misleading or counterfeit content, or content unrelated to the directory's purpose, is not allowed. Listing stock presented as vintage when it isn't is grounds for removal.
Vinté+ reviews applications and may review content afterwards, but it doesn't verify every published piece. The shop always answers for what it sells.
The shop keeps ownership of its content and grants Vinté+ a non-exclusive, royalty-free licence to display it in the directory, in the app and in the service's communications, for as long as the subscription lasts and for the sole purpose of providing the service.
Suspension and removal
Vinté+ may suspend or remove a listing if it breaches these terms, if the business ceases to exist or to be where it claims, or if there is an unpaid charge that Stripe cannot resolve after its retries.
Except in serious cases or where the law requires it, we give notice first and allow time to put things right. If the removal isn't attributable to the shop, the unused part of the period is refunded.
An unpaid invoice doesn't cut the service off immediately: while Stripe retries the charge, the shop keeps its plan. An expired card is not a cancellation.
Availability and liability
We take care to keep the service available and the information accurate, but we don't guarantee uninterrupted or error-free operation. There may be downtime for maintenance or third-party provider failures.
Vinté+ is not liable for indirect damages, loss of profit or loss of business opportunities. To the extent the law allows it to be limited, total liability towards a shop will not exceed the amount that shop has paid in the twelve months before the event giving rise to it.
None of the above limits liability for wilful misconduct, gross negligence or in cases where the law does not allow it to be excluded.
Changes to these terms
If these terms change substantially, we give thirty days' notice to the shop's email address. Anyone who doesn't accept the changes can cancel before they take effect, at no cost and with no penalty.
Changes that don't affect rights or obligations — a wording fix, a clarification — are published without prior notice, stating the date of the last revision.
Governing law and disputes
Spanish law applies. For any dispute, and as this is a business-to-business relationship, the parties submit to the courts of València, waiving any other forum they may be entitled to.
Before going to court, the parties undertake to try to resolve the disagreement in good faith by writing to the contact address in the legal notice.
Who provides the service
The full identifying details — name, tax ID, address and email — are in the legal notice. How personal data is handled is explained in the privacy policy.
